Pious Hearts is a website created to help singles find a spouse online. It is created for single Muslims who have the intention of getting married. Pious Hearts is not to be used as a dating site, and members who use this site as such will be removed and banned from the site with no refunds given. Pious Hearts is designed for any user that is 18 years of age and older. Anyone who is under 18 years of age is not authorized to use this service and will be removed from the site. We advise all our members to conduct themselves in an Islamic manner. We also strongly advise that our Muslim sisters advise and obtain the requisite permission of their wali/guardian/mahram before initiating communication with our Muslim brothers.
Pious Hearts has the right to change or amend any of the Terms and Conditions at any time. You may receive an email to notify you of any changes and updates. It is the member’s responsibility to read these Terms and Conditions. All updates, changes and/or amendments will be posted here. As a member of Pious Hearts, you automatically agree and consent to these Terms and Conditions. By using our website, you agree to our Privacy Policy and Terms and Conditions.
As a member and a user of Pious Hearts website, you are agreeing to the following Terms of Use:
Minimum Age: All members must be at least 18 years of age to access, register, and use our online matrimonial site.
Marital Status: All members must be single, legally divorced, or widowed. By requesting to use, registering to use, or using the Matchmaking Service, you represent and warrant that you are not married. If you are separated, but not yet legally divorced, you may not request to use, register to use, or use Pious Hearts. A member found to have mischaracterized their marital status shall have their subscription/membership terminated with no refund given.
Legal Status: All members must be legal residents of the UNITED STATES OF AMERICA. Anyone who has an illegal status, an expired visa, or is otherwise undocumented, shall not register or be allowed to use this site. A member found to have mischaracterized their status in the United States of America shall have their subscription/membership terminated with no refund given.
Criminal Status: By requesting to use, registering to use, or use Pious Hearts, you represent and warrant that you have never been convicted of a felony and/or are not required to register as a sex offender with any government entity. Pious Hearts currently does not perform criminal background checks on its members. However, Pious Hearts reserves the right to perform a criminal background check at any time to verify compliance with this provision. By agreeing to these terms, you hereby authorize any such check. Any prospective member or member found to have outstanding warrants for their arrest, and any prospective member or member found to be or have been required to register as a sex offender, shall have their subscription/membership terminated with no refund given.
Updated Information:
Each member is responsible to keep their information up to date. It is not Pious Hearts responsibility to make sure members’ information is current after initial matchmaking video consultation, including but not limited to the residence, career status, etc. All updated information must be submitted to site administration, or the member can update their information on their profile. Falsifying information will not be tolerated and shall be grounds for termination of subscription/membership with no refund given.
Payment and Billing:
Pious Hearts, LLC will automatically bill your payment method on file up to five (5) days prior to your service renewal date, depending on what type of subscription you have chosen; We may charge you every month or every 3 months or every year. You expressly acknowledge, agree, and authorize us to automatically bill the applicable fee and/or charge your credit card or other payment methods on file for each Renewal Term, unless you terminate or cancel the Services before such charge as provided in this section. All fees are billed in United States Dollars (“USD”) and are subject to change with prior notice to you.
Pious Hearts, LLC is only able to automatically collect payment from customers with credit cards stored on file or with active Stripe agreements and/or subscriptions. All other payment methods if accepted and approved by the Pious Hearts team (e.g. one- time credit card payments, check, money order, Square and PayPal one-time payments, etc.) must be initiated manually by the member. It is the member’s responsibility to ensure that all fees are paid no later than their due date. As a customer of Pious Hearts, LLC it is the member’s responsibility to ensure that all billing information on file with Pious Hearts, LLC is accurate and that any credit card or other automated payment methods on file has sufficient funds for processing. The member is solely responsible for any fees charged to or for the member’s payment method by the issuer, bank, or financial institution including, but not limited to, subscription/membership, overdraft, insufficient funds, and over the credit limit fees. Pious Hearts, LLC screens all orders for fraud. In certain cases, if a member’s account is flagged for fraud, the member’s order will not be processed. Pious Hearts, LLC has no liability for not providing services, including third-party services, if a member’s account fails the fraud screen.
Any account not paid by the first day of every billing period their subscription will be canceled. Pious Hearts, LLC is not responsible for any damages or losses (including any data) as a result of suspension or termination for non-payment of a member’s account. Also, Pious Hearts, LLC reserves the right to refuse to re-activate a member’s services unless and until any outstanding invoices have been paid in full.
Pious Hearts, LLC may, in and at its discretion, provide discounts to members. Pious Hearts, LLC reserves the right to not offer a discount on improper terms and/or for the following bases: untimely communication with the Pious Hearts, LLC team and or the matchmakers, unable to provide good quality pictures, and refraining to consider proposed matches without well-grounded reasons, and justifications. We are dedicated and committed to helping our members and we expect the same level of dedication and commitment of our members in finding their match. We are dedicated to finding members matches based on member’s preferences; however, Pious Hearts, LLC matches are proposed based on likely compatibility and shared values, and we cannot guarantee that proposed matches will meet your exact requirements.
Cancel Subscription:
Any member who wishes to cancel their subscription may do so by choosing from one of these two ways. If a member would like to cancel their subscription themselves they must do it at least two days before there next automatic subscription charge. Login into your Pious Hearts account and click on your profile name, then click on subscription and billing. Once you are under the subscription and billing page you can click on the auto-renew checkbox to remove the checkmark and click update to save this change to cancel your subscription. The other way to cancel your subscription is to notify the Pious Hearts team in writing in the form of an email to info@pioushearts.com, 10 days before the subscription services renewal date. You may use your subscription until the end of your then-current subscription term; your subscription will not be renewed after your then-current term expires (provided you canceled your account in one of those two ways we offer). The cancellation of subscription/membership or ceasing all use of our Website is a member’s only remedy concerning any such dispute that you may have with us. We will attempt to process all cancellation requests within a reasonable time frame. However, you won’t be eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period. We do not issue refunds for any canceled subscriptions/memberships.
Refunds:
To the extent permitted by applicable laws and regulations, no refunds will be offered or issued (Pious Hearts team reserves the right to make exceptions on a case by case basis, to award refunds in some cases and if so we have the right to charge the member a 20% process/refund/transaction fee). There will be no refund of any payment made by you for a paid subscription if you haven’t submitted your profile to start your matchmaking service. All members are held accountable for filling out their profile and submitting it in a reasonable time in order for a matchmaker to be assigned and contact the member. If a profile is rejected by the Pious Hearts team upon a submitted profile, the member must address the issues that caused this rejection and resubmit their profile to get it approved by the Pious Hearts team, once approved you will be assigned a matchmaker to schedule a video matchmaking session. From the day you pick a package and make a payment you are considered a member and agreed to a subscription package, from that date you will be charged the package subscription automatically you agreed upon.
Auto-renewal
Our services are a subscription service that is set up to auto-renew and any matchmaking package you select is with an agreement to a subscription service. Your Pious Hearts subscription will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected, at the then-current non-promotional subscription rate. If you would like to cancel your subscription please refer to the section: cancel subscription.
Termination
Any member found to have violated any of the above terms will be terminated from the site. If we determine, in our sole discretion, that a member is not in compliance with the terms of use and these Terms and Conditions, we reserve the right to terminate the member’s subscription/membership and/or usage of our site with no refunds issued.
Safety:
No Guarantees: Pious Hearts is not responsible for any inaccurate or incorrect content that is provided or transmitted by our users, or associated with the services in any way. We are not responsible for the actions, words, or conduct, whether online, offline or otherwise, by any user of the services. We are not responsible for any errors or delays in communications between users. We are not responsible for the content of messages, or in-person communications, between users. We are also not responsible for any unauthorized access to the accounts of our users. Pious Hearts is not responsible for any damage to users, including but not limited to, loss, damage, personal injury, theft, or death resulting from anyone’s use of the Services. We are not responsible for any technical malfunction, failure, or damage to your computer as a result of using or visiting the Website or our Services. As confident as we are in our match-making abilities, Pious Hearts does not guarantee that using the services will result in a marriage, and we do not guarantee that using the services will result in any type of relationship or relationship potential between you and another person or group of people. We will try to introduce you to eligible singles who meet your criteria for a life-partner. We will make a conscious effort to perform interviews with all of our clients before recommending them to you. We cannot guarantee what happens after two of you met. Pious Hearts does not guarantee your compatibility, offline or online, with any other users of the site, whether recommended, suggested, or not. Any advice that may be posted on the Website is for entertainment purposes only, and you agree that it is not to be used to substitute for any professional relationship, medical, financial, legal, or other advice.
Each member must be mindful and careful when dealing with any other member. We advise and recommend that family members, guardians, or wali/mahram, be notified of all the interactions between members. All members must conduct themselves in an Islamic manner. Pious Heart is not liable for any type of abuse; physical, mental, verbal, or sexual that may occur offline. This includes theft of all sorts including financial and identity theft.
Pious Hearts stresses each member to put safety first before interacting with any other member. It is the member’s responsibility to bring to the attention of the administration any illicit or offensive behavior, including but not limited to promotion or solicitation of illicit drug use and alcohol consumption, promotion or solicitation of violence, the use or dissemination of pornography, engaging in or the solicitation of human trafficking, communicating threats (verbal or nonverbal), the use and misuse of web content containing links which pose risks of viruses, malware, or spyware, the use and misuse of confidential and/or private information about other members
Members on Pious Hearts assume all risks and liabilities of engaging with other members when using our site. We strongly urge members to take all precautions when interacting with any member online or in-person.
USER COMMUNICATIONS, TRANSACTIONS, INTERACTIONS, DISPUTES AND RELATIONS
Pious Hearts and Pious Hearts Representatives are not parties to, have no involvement or interest in, make no representations or warranties as to, and have no responsibility or liability with respect to any communications, transactions, interactions, disputes or any relations whatsoever between you and any other user, person or organization (“your interactions with others”). You must conduct any necessary, appropriate, prudent or judicious investigation, inquiry, research or due diligence concerning your interactions with others.
You agree to indemnify and hold Pious Hearts and Pious Hearts Representatives harmless from and against any third-party claim, cause of action, demand or damages related to or arising out of: (a) content that you post or transmit (including but not limited to content that a third-party deems defamatory or otherwise harmful or offensive); (b) activity that occurs through or by use of your account (including, without limitation, all content posted or transmitted); (c) your use of or reliance on any user content; and (d) your violation of the TOS. This indemnification obligation includes payment of any attorneys’ fees and costs incurred by Pious Hearts or Pious Hearts Representatives.
Affiliated organizations and Matchmakers
Pious Hearts wants to provide you with the best outcome while being a member with us. Although we have our own member database who you may be matched with, your matchmaker will not limit your search within our database. Our goal is to find you that special one, this is why we are affiliated with other organizations such as professional companies like our own, masjids, solo matchmakers, social media groups, friends, family, conventions, singles events, etc. To better find you a suitable match.
Social Media Sites
Pious Hearts has several social media sites where information will be sent to promote our business. Permission will be asked before any pictures of a member are placed on the site. If a member changes his/her mind about their picture on the site, they must inform the administration in a written email form to info@pioushearts.com that they want their picture/video or information removed from the site.
Accounts:
Account sharing is not allowed. One account per person.
A member may not transfer their account to another member or prospective member; however, any such transfer must be approved by us in advance of any transfer or attempted transfer. Approval shall be sought by written request to us, and approval shall be granted on a case-by-case basis and in and at our sole discretion.
Purchasing and selling of subscription/memberships are forbidden, and members found engaging or attempting to engage in such conduct will have their subscription/membership terminated with no refunds given.
A member who has been terminated cannot become a member again on our site.
Accounts that are found to have falsified information will be terminated with no refunds given.
